As the media buzz heralding the just announced appointment of Mr. Ola Olukoyede is about settling down, a quick check on the laws establishing the Economic and Financial Crimes Commission has revealed that President Bola Ahmed Tinubu has committed a fundermental error in announcing Olukoyede as replacement for Rasheed Bawa, who was suspended, arrested and later resigned his appointment as chairman of the anti-graft commission.
A look at Section 2(1) of the ammended 2004 Establishment act of the commission reveals that:
2: (1) The Commission shall consist of the following members –
(a) a chairman, who shall -
(i) be the Chief Executive and Accounting Officer of the Commission.
(ii) be a serving or retired member of any government security or law enforcement
agency not below the rank of Assistant Commissioner of Police or equivalent;
and
(iii) Possess not less than 15 years cognate experience
