NBA ADVOCATES FOR NJC REFORM, CALLS FOR CJN's REMOVAL AS CHAIRMAN

  The Nigerian Bar Association (NBA) has urged for a comprehensive overhaul of the National Judicial Council (NJC), citing the need for greater independence and accountability in the body responsible for judicial appointments and discipline.  Currently, the Chief Justice of Nigeria (CJN) serves as the chairman of the NJC, a arrangement the NBA deems flawed. According to the NBA, "The present composition of the NJC undermines its ability to effectively investigate and discipline judicial misconduct, thereby eroding public trust." To address this, the NBA recommends a revised composition for the NJC, comprising six judicial officers appointed by the CJN, six lawyers nominated by the NBA, and six non-lawyers appointed by the President and confirmed by the Senate.  The chairmanship of the NJC would rotate among the three constituent groups. COURT AFFIRMS JUSTICE ADEPELE OJO AS OSUN CHIEF JUDGE

The National Industrial Court sitting in Ibadan has affirmed Justice Adepele Ojo as the Chief Judge of Osun State. The decision was contained in a judgment delivered by Justice Peters in a suit numbered NICN/IB/62/2023. The court granted all the reliefs sought by the Osun Chief Judge against the Osun State Government and Osun State House of Assembly, including an order of perpetual injunction restraining both the executive and legislative arms of government from removing her as the number one judicial officer in the state. Matters came to a head between Osun State Government and Justice Ojo in 2023, when the state assembly passed a motion suspending her as Chief Judge of the state. BREACH OF CONTRACT: SUPREME COURT ORDERS P-SQUARE TO PAY 25M TO PROMOTER

The Supreme Court of Nigeria has delivered a landmark judgment in a long-standing breach of contract case, ordering popular music duo P-Square (Peter and Paul Okoye) and their brother Jude Okoye to pay promoter Patrick Arueze approximately N25 million in damages. The case, which dates back to 2011, arose when Arueze invited P-Square to perform at a show in Benin City, but the group failed to appear.  Arueze subsequently filed a lawsuit against the Okoyes in the Edo State High Court, presided over by Justice Esther Edigin, alleging breach of contract. The Okoyes attempted to reverse the judgment through a motion dated October 3, 2016, but the court dismissed their appeal.  Undeterred, they filed a motion for stay of execution at the Court of Appeal, Benin Division, which was also dismissed.  The musicians later issued a cheque through a commercial bank to settle the matter, but when Arueze presented the cheque to the bank, the Okoyes instructed their lawyers to file another motion at th

The Legal Practitioners Disciplinary Committee (LPDC) has struck out the name of Adekunbi Ogunde from the roll of Legal Practitioners in Nigeria. YORUBA NOLLYWOOD ACTOR, BABA IJESA APPEALS CONVICTION

Yoruba Nollywood actor, Baba Ijesha, has filed an appeal with the Lagos Division of the Court of Appeal, seeking to overturn his conviction for sexually assaulting a minor.  In July 2022, Justice Oluwatoyin Taiwo of the Ikeja Domestic Violence and Sexual Offences Court sentenced Baba Ijesha to five years in prison.  Baba Ijesha's legal team, led by Kayode Olabiran, contended that he was set up and acted according to a script provided by his colleague, Damilola Adekoya.  The defense claims that Baba Ijesha was invited to act in a scripted scene and was not aware of the alleged sexual assault.  However, Lagos state Director of Public Prosecution, Dr. Babajide Martins, urged the appeal court to dismiss the appeal, citing lack of merit and a misunderstanding of the case.  Martins asked that the lower court's judgment should be upheld."

OYO MONARCH REMOVED FROM OFFICE, FOLLOWING COURT ORDER

A judgment by the Oyo State High Court in Ibadan has nullified the selection and appointment of Oba Oyeleye Sakirudeen as the Onifiditi of Fiditi.  The court, presided over by Justice K.B. Olawoyin, granted a mandatory injunction setting aside the presentation of the Staff of Office to Oba Sakirudeen on October 18, 2021, by the Oyo State Governor, Seyi Makinde, and other officials.  The court also restrained all defendants from taking further actions towards filling the vacant stool of the Onifiditi of Fiditi pending the determination of the suit.  The plaintiffs, Samuel Ogunkunle and Bayo Oyewale, were represented by R. A. Olawuwo and B.M. Olimene, while the defendants were represented by various counsel.  The court awarded a cost of N200,000 in favor of the plaintiffs and adjourned the suit until May 22."

LAUTECH FACULTY OF LAW WELCOMES INAUGURAL CLASS THIS SESSION

Ogbomoso - Ladoke Akintola University of Technology (LAUTECH) has announced the establishment of a Faculty of Law and introduced six new degree programs in the Faculty of Arts and Social Sciences.  This development was confirmed by the acting Vice Chancellor, Prof. Razaq Olatunde Rom Kalilu, during the 16th convocation ceremonies held in the Great Hall. The Chief Justice of Nigeria, Kayode Ariwoola, has nominated 22 Judges from state and federal high courts for promotion to the Court of Appeal.  The list of newly nominated justices, titled ‘Appointment of 22 Justices to the Court of Appeal,’ was signed by Justice Ariwoola on April 2, 2024, and marked FJSC/01/2024. BODIJA EXPLOSION: COURT ORDERS VICTIM TO COMMISSION PRIVATE INVESTIGATOR, TO UNRAVEL CAUSE OF DISASTER

A Chief Magistrate court sitting in Iyaganku, Ibadan has granted an order for leave of court to commission a private investigator to investigate and come up with a report on the immediate and remote cause(s) of the January 16, 2024 explosion which rocked the Bodija area of Oyo state.
